NO PURCHASE OR OBLIGATION NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

As a condition of participating in this Contest, you agree to be fully and unconditionally bound by these Official Rules and the decisions of Liquor.com Holdings, Inc. (the “Sponsor”) and waive any right to claim ambiguity in the Contest or these Official Rules.

1. ELIGIBILITY

The Ultimate Tequila & Mezcal Experience, hosted by Jacques Bezuidenhout Contest is open to all entrants who are at least 21 years old at the time of entry and are legal residents of the United States, not including Tennessee, Utah, Hawaii and Alaska. All Entrants must also be working bartenders. The Contest is subject to all applicable federal, state, and local laws and regulations and is VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

Employees and shareholders of Sponsor, Wildfire, Inc. and its Partners (defined below), as well as their immediate family (spouse, and parents, children and siblings, and their respective spouses regardless of where they live) and individuals living in the same households as the employees or shareholders, whether related or not, are not prohibited from playing the Contest for fun. However, all such individuals are not eligible in any way and are completely restricted from winning any prizes, awards or cash in any manner in connection with the Contest.

2. HOW TO ENTER

You may participate in the Contest for the Prizes by submitting an eligible entry during the Promotional Period, which shall begin on May 03, 2013, at 12:00 AM PDT and end on February 15, 2014, at 11:59 PM PDT. Determination of the winner (defined below) will occur at the end of the Promotional Period.

There is one (1) way to enter the Contest, all without purchase or obligation:
[Electronic Entry] You may enter the Contest for the Prize by registering on Facebook or the hosted microsite, providing an email address for which you are the authorized user and your age, answering the required essay question and agreeing to the Liquor.com Terms and Conditions. You may only register once during the Promotional Period.

(No phone calls, mail or facsimiles will be accepted regarding this Contest. Incomplete submissions or submissions sent outside of the Promotional Period will not be considered.)

“Authorized user” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the email address.

Any form of entry other than those described herein is void. All entries, regardless of the method of entry, become the property of the Sponsor and will not be returned.

3. PRIZES AND JUDGING CRITERIA

To claim the Prize, your entry must be selected as a winning entry. One prize will be awarded:

Round-trip airfare to San Francisco
Hotel accommodations
One-on-one tequila and mezcal tasting and lesson with Jacques Bezuidenhout
Sampling of rare and hard-to-find bottlings from Jacques’ private collection
Dinner and drinks at Tommy’s, which has one of the most extensive tequila collections in the country
Estimated Retail Value: $1,450
Prize winner must redeem the Prize within 72 hours of being selected as the winner.

The specific itinerary, features, activities, and availability of the Prize are subject to change at any time.

The Prize will be awarded to best essay (300 words or less) as judged by Jacques Bezuidenhout in response to the following questions:
1. What do tequila and mezcal mean to you in your bar program?
2. When selecting tequila and mezcal brands for your back bar, what drives your purchasing decisions?
3. What are your thoughts on the influence of the CRT and CNIT on tequila production?
4. What are your stylistic preferences for tequila with regards to growing regions within the 5 legal production states?

The Contest will be administered by Wildfire, Inc. The Prize winners in any Contest will be determined by Wildfire, Inc. and Liquor.com, whose decisions are final and binding in all respects. No entrant or winner shall have the right to contest any decision by Sponsor or Wildfire, Inc. concerning any aspect of the Contest or the interpretation of the Official Rules or the determination as to the qualification of entries.

All players are limited to and restricted from winning more than one Prize during the Contest. Where a prize is forfeited, an alternate Contest Potential Winner will be chosen from all entries received.

A. WINNERS’ RESPONSIBILITIES

Winners are responsible for the payment of all taxes and for any other costs and expenses associated with the acceptance of the prize. Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) by Sponsor. There will be no substitution or compensation for any Prize, or any part of such Prize, if it is forfeited due to winner’s non-compliance with these Official Rules. The right to receive the Prize is non-assignable and non-transferable and no Prize substitution, transfer, cash equivalent or exchange will be allowed except by Sponsor at its sole discretion.

Any required tax reporting forms will be furnished to the IRS.

B. PRIZE LIMITATIONS

No other Prizes will be awarded by Sponsor unless otherwise notified. ALL PRIZES WILL BE AWARDED ON CONDITION THAT SPONSOR REMAINS OPERATIONAL AND SALEABLE. IN THE EVENT THAT SPONSOR, FOR ANY REASON, BECOMES UNPROFITABLE AND UNABLE TO REMAIN OPERATIONAL, ALL ENTRANTS WILL HOLD SPONSOR HARMLESS FOR ANY DEBT OR PAST OBLIGATIONS.

4. WINNERS’ NOTIFICATION

The Prize winner will be notified via the email address associated with the winner’s account.

Winner must complete and return an Affidavit of Eligibility and/or Proof of Identity Form provided by Sponsor, as well as any other documentation required by Sponsor in accord with these Official Rules, within 30 days of notification. If winner fails to return these documents in 45 days, or if the Prize notification or Prize is returned as non-deliverable, or if winner is found not to be in compliance with these Official Rules, or is otherwise ineligible, the winner’s Prize will be forfeited. Any forfeited Prize, at Sponsor’s discretion, may be awarded to an alternate winner.

5. 30-DAY RULE FOR DISTRIBUTION OF ALL WINNING PRIZES

Sponsor reserves the right to restrict the awarding of any prizes for up to, but not limited to, 30 days, in order to process, verify and inspect code and programming for fraud, manipulation or tampering. This inspection process may be conducted by a third-party vendor or by Sponsor at its sole discretion in order to secure the integrity and authenticity of Sponsor’s web services. If in the opinion of Sponsor, Wildfire, Inc. or its Partners, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, or if winner has violated of these Official Rules, or acted in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, slander or harass any other person, including Sponsor and its Partners, in any way, Sponsor reserves the right at its sole discretion to disqualify any such individual and/or void any entries submitted fraudulently, to modify or suspend the Contest, and/or to terminate the Contest. Any attempts by an individual to access any web site associated with the Contest via robotic, automatic entry devices, programs such as, but not limited to, by script, macro or any other automated means, or other unauthorized entry will void all such entries by such methods.

ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE SPONSOR’S WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE Contest MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW.

6. PUBLICITY

Except where prohibited by law, by entering the Contest, as a condition of participating in this Contest, you agree to the use by Sponsor and its designees of your name, photograph, likeness, statements, biographical information, voice and city and state address for advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without additional compensation, review or approval rights, notification or permission, except where prohibited by law. At the option of Sponsor, winners may be required to execute a Publicity Release.

YOU FURTHER ACKNOWLEDGE THAT IF YOU ARE A WINNER, YOUR IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, BEING PLACED ON A WINNERS’ LIST.

7. LIMITATION OF LIABILITY

Sponsor and its Partners are not responsible for: (1) stolen, lost, late, misdirected, damaged, undeliverable or incomplete, inaccurate, delayed, illegible entries due to technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the mailing or transmission of entries, notification or correspondence, the processing of entries, the announcement of the prize or in any Contest related materials; (2) technical failures of any kinds; (3) failures of any of the equipment or programming associated with or utilized in the Contest; (4) unauthorized human and/or mechanical intervention in any part of the entry process or the Contest; (5) technical or human error that may occur in the administration of the Contest, the sending of entries or the processing of entries; or (6) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from your participation in the Contest or receipt or use of any prize. If for any reason your entry is confirmed to have been erroneously deleted, lost or otherwise destroyed, corrupted or for any other reason not accepted as an entry into the Contest, your sole remedy is to submit another entry in the Contest. If, for any reason, the Contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the opinion of Sponsor, Wildfire, Inc. could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Contest for any drawing(s) and select a winner from entries received for that drawing prior to the action taken or in such other manner as Sponsor deems fair and equitable.

As a condition of participating in this Contest, you agree to release, indemnify and hold harmless Sponsor, Wildfire, Inc. and its Partners, as well as Sponsor’s affiliates, advertising and promotion agencies, and each of their respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the Contest or acceptance, possession, use, misuse or nonuse of the Prize that may be awarded or for any injury or damage to your or any other person’s computer or wireless device relating to or resulting from participation in this Contest or downloading any materials in this Contest, or inability to access any web site or wireless service associated with this promotion, or any combination thereof. You agree that the laws of the State of California will govern any and all disputes. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or your and Sponsor’s rights and obligations in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine, and all proceedings shall take place in San Francisco, California, USA. At the option of Sponsor, the Prize winners may be required to execute a separate Liability Release.

As a condition of participating in this Contest, you agree that (1) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (2) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (3) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys fees.

Sponsor reserves the right to modify, change or enhance the eligibility, rules and/or jurisdiction for the Prize, and the prize itself. Any such change or modification will be announced in a manner deemed appropriate by Sponsor, in which case the change, alteration or modification will become effective immediately and will be incorporated and published into the Official Rules. Sponsor shall, however, be under no obligation to make any such change or modification.

Sponsor reserves the right to terminate the Contest by giving notice as deemed appropriate by Sponsor at its sole discretion, in which case the Contest will terminate immediately. Sponsor may give email notice of any such cancellation, suspension or termination of play, but shall not be obligated to do so. In the event the Contest is terminated, the Prize will nevertheless be awarded as provided in these Official Rules.

8. PRIVACY

Sponsor collects personal information from you when you enter the Contest. The information collected is subject to Sponsor’s Privacy Policy found at http://liquor.com/pages/privacy-policy/. However, you agree that Sponsor may share your personal information with its partners, sponsors, advertisers, service providers and marketers for marketing promotions, lookup and reference services applications, and other entities that Sponsor believes can provide you with special offers and opportunities. If you do not provide the required personal information or you do not agree that Sponsor may share your personal information with such third parties, you may not register to play on this web site. If you do not agree that Sponsor may share your personal information with such third parties and you are already registered, you should immediately terminate your account by informing Sponsor via support@liquor.com.

10. OPT-OUT

By registering with Sponsor, you consent to receive periodic information, promotions, games, and giveaways from Sponsor and/or other third parties, and/or results concerning your account via electronic email as provided in these Official Rules. If you do not provide the required personal information or you do not agree that Sponsor may share your personal information with such third parties, you may not register to play on this web site. If you do not agree that Sponsor may share your personal information with such third parties and you are already registered, you should immediately terminate your account by contacting Sponsor via support@liquor.com.

You have not yet won a prize. The actual odds of winning any prize will depend upon the applicable contest as described above.
